Terms and Conditions

For a single lesson, a pack of 5 or 11 lessons:

(the Teacher) offer tuition on the following Terms and Conditions:

Tuition

Tuition will be given in a single first lesson and after that, a pack of lessons. Number of lessons per pack: 1, 5 or 11 Length of each lesson: 55 minutes.

Dates of lessons: Dates are scheduled by the client, parent or carer of the client from the teacher s availability calendar at the point of purchase.

Location of lessons: Chosen at point of purchase from two options: At the teacher s music studio in Kings Langley or on Zoom.

Fees

Lessons will be charged at the rate stated in writing at time of purchase.

The Teacher may increase fees on the booking system, and these increases will apply at the point of purchase of a future pack of lessons. A pack already paid for must be used within one year and will not be subjected to any fee increases even if increases are applied for new purchases.

Conditions

The Conditions set out below will apply to this Agreement. By paying the fees, ticking the Terms and Conditions box and making the purchase, you will be deemed to agree with these terms and conditions. They will constitute a legally binding personal contract between the teacher and client or the client s parent or carer.

However, the Client (or the Client s parent or carer) will have the right to cancel this Agreement within 14 days from the day after the date of this Agreement by giving written notice of cancellation to the Teacher by emailing her at [email protected]. For the purposes of this Agreement written notice must be given by email.

If the Client would like lessons to begin within the 14 day cancellation period, the Client (or parent or carer) must provide the Teacher with written confirmation of this. If the Agreement is then cancelled within the 14 day cancellation period, the Client is required to pay the fees for any lessons delivered and any other fees paid to the Teacher will be refunded.

Once the 14 day cancellation period has expired, the Agreement will remain in force continuously until the end of the day of the last scheduled lesson.

Conditions of music tuition:

1.      Lessons

The Teacher will give tuition in lessons consisting of the number of lessons paid for in the pack: 1, 5, or 11. The Teacher will give the lessons at the time booked on the calendar by the client or parent or carer of the client and at the location specified at the time of purchase and the Teacher will reserve this time slot/slots for the Client.

2.      Client health information

The Client is responsible for informing the teacher immediately if they do not wish to do a certain exercise. The Client also has the responsibility to inform the teacher if they have any health conditions that they consider to be relevant.

3.      Payment of fees

The Client (or the Client s parent or carer) will pay the fees in full for in the first instance 1 lesson, or after that 5 or 11, at least 3 days before the first lesson. At the time of payment, the client will have to schedule all the lessons from the teacher s available lessons on the calendar. Lessons are not transferable to another individual.

4.      Lesson timetable

The Client (or the Client s parent or carer) will receive an email confirmation of the dates and times of all lessons in the pack. The client can reschedule booked lessons 3 or more days before the scheduled time of the lesson.

5.      Missed and cancelled lessons

The Teacher will charge for any scheduled lessons which the Client does not attend. The client can reschedule booked lessons 3 or more days before the scheduled time of the lesson. Clients who cancel a lesson without rescheduling it will not be refunded, unless the Teacher chooses to do so because of exceptional circumstances and at least 48 hours notice given before the scheduled time of the lesson.

If the Teacher cancels a scheduled lesson, the Client (or the Client s parent or carer) may choose between (i) rescheduling the lesson; or (ii) receiving a refund of the lesson fee.

6.      Examinations, competitions and public performances

The Client will not be entered for any examination, competition or public performance without the prior consent of both the Teacher and the Client (and the Client s parent or carer, where appropriate).

7.      Termination of tuition

This Agreement will end at the end of the final lesson of the pack. A new agreement will commence at the point of purchase of another pack.

If the Client stops attending lessons while a pack is ongoing, the Client (or the Client s parent or carer) is not entitled to a refund of any fees paid for that pack. The Client is entitled to attend any lessons paid for and scheduled.

If the Teacher stops lessons before the end of the pack of lessons, the Teacher shall refund any fees already paid for any lessons not given.

8.      Conduct

If the Teacher, in his or her reasonable opinion, feels unable to continue tuition on account of unreasonable conduct by the Client or anyone connected with the Client, the fees for any outstanding lessons will not be refundable.

9.      Changes

(a)    Any changes to the terms of this Agreement will not affect ongoing previous agreements, but only new contracts entered into by the purchase of another pack of lessons.

(b)   If the Teacher chooses to waive any right or remedy under this Agreement or otherwise (for example, if the Teacher chooses to waive fees for any lessons which the Client does not attend) this shall not mean that he or she must do so in future or that he or she waives any other rights or remedies, unless agreed in writing.

10.  Governing law and jurisdiction

This Agreement shall be subject to the laws of the jurisdiction of the location of the teacher in the UK those clients agreeing to this Agreement agree that any dispute relating to the subject matter of this Agreement shall be subject to the exclusive jurisdiction of the courts of that UK jurisdiction.
